On May 28, 2024, Decree Law 3/2024 of the Balearic Islands was published in the BOE.  In said decree there is an extraordinary legalization procedure for constructions on rural land that is included in the seventh transitional provision.

How much will it cost to legalize my home?

The main costs are:

  1. Architect fees for drafting the legalization project.

  2. Payment of the corresponding license fee

  3. Payment of the Tax on Constructions, Installations and Works (ICIO)

  4. Carrying out environmental improvement works.

  5. Costs of registration in the Property Registry of the limitation of destination to tourist rental.

 

Payment of the “economic benefit”, calculated on the cost of material execution, as if the work were done new. This cost increases over the years, thus encouraging owners to legalize as soon as possible:

  • 10% if requested in the first year.

  • 12.5% ​​if requested in the second year.

  • 15% if requested in the third year

There are a number of bonuses for tax residents in Spain.

Procedure

To initiate the procedure, an application for an extraordinary legalization licence is submitted.
This application for extraordinary legalization license, must be accompanied by a draft written by architect. In addition, to be able to carry out the legalization, it will be necessary to carry out a series of works on the building focused on Reducing the light pollution of the building; Improving energy or water efficiency; Implement adequate water purification systems.
